Your agreement for accessing and using Monvera services in the EU.

Scope & Acceptance

These Terms of Use (“Terms”) govern your access to and use of Monvera websites, apps, and services. By using our services, you agree to these Terms. If you do not agree, do not use the services.

Eligibility & Accounts

  • You must be at least 18 years old and have the legal capacity to enter into contracts.
  • You are responsible for maintaining the confidentiality of credentials and for activities under your account.
  • Provide accurate information and keep it up to date.

KYC/AML & Compliance

You agree to provide information necessary for KYC/AML, sanctions screening, and ongoing monitoring as required by applicable law. We may refuse, suspend, or terminate services where compliance obligations are not met.

Acceptable Use

  • No unlawful, fraudulent, or abusive activity; no infringement of intellectual property or privacy rights.
  • No interference with service integrity or security; no reverse engineering except as permitted by law.
  • No prohibited transactions, including those violating sanctions or financial crime rules.

Fees & Taxes

We may charge fees (e.g., account, FX, transaction). Any applicable fees will be disclosed prior to use. You are responsible for taxes arising from your use of the services.

Financial/Crypto Disclaimer

Unless expressly authorised and stated, Monvera is not a bank and does not provide investment advice. Cryptoassets are volatile and can result in loss of value, including total loss. Past performance is not indicative of future results. Ensure you understand the risks before using crypto-related features.

Intellectual Property

All content, trademarks, and technology in the services are owned by Monvera or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the services as permitted by these Terms.

Privacy

Your use of the services is subject to our Privacy Policy, which explains how we process personal data under GDPR.

Third-Party Services

We may integrate third-party services (e.g., payment partners, KYC providers). Those services have their own terms and privacy policies; we are not responsible for their practices.

Warranties & Liability

Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties and limit liability for indirect or consequential losses. Nothing excludes liability for fraud, gross negligence, or where prohibited by law.

Indemnity

You agree to indemnify and hold Monvera harmless from claims arising out of your breach of these Terms, unlawful use, or violation of rights of others.

Suspension & Termination

We may suspend or terminate access for breach, risk, or legal reasons. You may terminate by closing your account and ceasing use. Certain provisions survive termination (e.g., IP, liability, dispute terms).

Governing Law & Venue

These Terms are governed by the laws of [Member State], without regard to conflict-of-law rules. Courts in [City, Member State] have exclusive jurisdiction, except where mandatory consumer venue rules apply.

EU Consumer Information

  • If you are a consumer, you may have statutory rights that cannot be excluded by contract.
  • Information duties under EU consumer law are met via these Terms, the Privacy Policy, and pre-contractual disclosures in the product UI.
  • Right of withdrawal may not apply to certain financial services or already-performed services; where applicable, instructions are provided during onboarding.

Changes to Terms

We may update these Terms. Significant changes will be notified in advance where required. Your continued use after the effective date constitutes acceptance.
